Very briefly (which is a first for me)

2 types of copyright here, totally seperate.

1) copyright in the actual song/composition - belongs to the original composer, rights may be administered by a publisher. Copyright lasts for 70 years AFTER original composers death. In the caser of multiple composers, 70 years after the death of the last remaining composer.

Permission needs to be granted by the author/composer/publisher of the work, even if it's a sample.

2) Copyright of the sound recording - this is the physical recording of the song/composition owned by the person/record company that created it. Copyright in this lasts forever, never expires.

Permission needs to be gained if you use ANY (even the smallest snippet) of this recording.

So.... cover the song, make ur own recording don't use any original samples from any other recordings and u need the permission of the author/publisher only.

Use a sample of any work and you need BOTH the aurthor/publisher and the priginal soud recording owner.

If you take even the smallest snippet of a sample, and make enough money from the track, if you didnt get permission, the sample owner will get musicologists, audiologists etc to prove that sample was theres. (digital prints, etc) and if the moneys enough, just the threat of taking you to court will be enough to make u give up the money.

Ask permission. Ive just done it with an old disco tune we sampled. It's easy and if you're honest, you shouldnt have any trouble.

One thing that has struck me about this topic is that it is going to confuse the hell out of people who are only just starting to learn about copyright.

There are several different forms of copyright. This is from the MCPS website:

A Musical work: The copyright in a musical work, including any lyrics, belongs to the songwriter or composer who wrote the work. It is often assigned to, or exclusively licensed or administered by a music publisher. The copyright period varies but in most cases it will expire seventy years after the year of the death of the composer or last surviving co-writer.

A Sound recording: The copyright in a sound recording belongs to the person who made the recording. This is usually deemed to be the record company, which holds a contract with the artist performing on the recording, or the artist itself. This copyright expires fifty years after the year in which the recording was first exploited.

A Performance: The rights to an artist's performance belong to that performer or to a party they may have sold or assigned this right to. This right applies to all types of performance including a performance in a studio for recording purposes. Rights in most artists' performances on record are dealt with by the record company who own that recording, but there are circumstances when a performers' rights must be addressed separately.


Copyright is an absolute minefield!!! I thought I had nailed down what was right and what was wrong, only to find that it was a load of balls when I came to put it into practice. I strongly suggest you have a look round the mcps and prs websites, and if you are unsure on some points then give them a call

What about the AMEN break. Its probably the most used sample ever, just imagine everyone wanting to use the sample having to get it cleared with the original artists, theyd be rolling in it just from the royalties.

I dunno, but I think that the "rules" are a little dated and should be changed. Thats why you should vote me as Supreme Overload of Earth
