I'm planning to make an album but the problem is my album would also include remixes.

I know about many rules of "fair use" but not about this topic, and I searched everywhere and didn't find the concreet answer. Does "fair use" apply if you make a free non-commercial remix downloadable, or is it against the law?

Ask the artist in question, just out of politeness if nothing else, it's their song. Otherwise i wouldn't risk it.

Law about internet differs from country of origin, right? I can imagine a scenario where it's illegal where you are and legal where I am.

Yeah, ask the artist and make sure to specify the labels in the tracklisting. Many have done it without prosecution though.

if its hardcore I wouldn't worry about it mate. plenty of hardcore producers do it even high profile and get away with it... unless you're signed to AATW I wouldn't worry too much

It probably is illegal, though I doubt you need to worry about any copyright claims as long as you're not making any money off it.

If the album and remix are free I don't think it should be a problem. Nothing illegal there. Ask the artist as well if that's possible. They might enjoy hearing it themselves!

I doubt that a lot (of the more popular ones) will really answer. I like to visualise the reaction of them, receiving following e-mail:

Cruelcore1:"Do you mind, if I do a remix of your track and put in on an album?"
Kosheen:"What the f**k is Cruelcore1?"

Probably his e-mail will be swallowed by spam filters anyway before this actually happens. Might doesn't count for Hardcore producers/djs.

Then I guess I'll have to ask the label. Eventhough I have sent them (artist organization) a polite formal e-mail with kind regards.
I guess I'll just exclude my favourite remix and hunt for label-less amateurs since the first album will be promotional only. =)

EDIT: Not really hunt, I'm not planning to hav that many remixes.

technically the copyrigt owner e.g who ever made the song, samples, accapellas etc has full say even if you want to play the track at a rave, on the tv or any public performance etc your ment to ask there permission 1st although nobody actually does of corse but the way it works is if you release it for free they cant make any royalites from it so whats the point of saying no?? just look at Gisbo (and before anyone says yes ive read the thread and i know hes got problems im just useing him as a example) before he got himself known he released lots and lots of (cheesy and remixed well known) songs for free on illiagle filesareing sites and everywhere on the internet with a text box!! just to get his name out there and im pretty certain he didnt ask them permisson 1st!! but it worked and he then started making his own stuf and selling it.

so to sum up i would ask 1st and give them say 7-14 days to reply if they dont reply then use it anyway at least your covered if they do get assey about it oh and dont spam 2 much there is a levelmost people accept and MOST IMPORTANTLY!!!!!!! accept critisim everybody is different and everyone likes different things at the end of the day its the public who listen to the tracks so listen to what they have to say and build on it, test what they say out especially from other DJ's and producers most of them know what they are doing ;) and if you cant take some constructive critisim then i wouldnt even start!!! lol oh and finally best of luck :D

It is illegal, making a remix of someones else and then releasing it is the same as sharing the original more or less.

You need to ask permission basically, but there are alot of "rips" in hardcore, if you're using an acapella from a commercial track then most artists use an alias. If you are going to remix a hardcore tune you need to ask permission as the track belongs to them and not you even if you remix it.

even free, it is borderline illegal. but it's mainly a problem when you're selling it.

even most of scott browns tracks who sample from movies, mainstream songs, etc. are illegal, especially since he profited it off of them. i doubt that he asked permission for the samples to boomstick.

funny how he complains when ppl remix his stuff yet he's illegaly using samples for his tracks.
